TERMS AND CONDITIONS OF THE WEBSITE WWW.WOLNEKURCZAKI.PL

§ 1. GENERAL PROVISIONS

These Terms and Conditions define the rules for using the website www.wolnekurczaki.pl (hereinafter referred to as the “Service”), including the rules for:
a) registering and maintaining a User Account,
b) posting advertisements for the sale and purchase of hatching eggs as part of the online exchange (Marketplace),
c) ordering and providing consulting and advisory services.
Before using the Service, the User is obliged to read and accept these Terms and Conditions.

§ 2. DEFINITIONS

Service – the online exchange and information/service platform available at wolnekurczaki.pl.
User – a natural person with full legal capacity, a legal entity, or an organizational unit without legal personality, using the Service.
Account – an individual User panel within the Service, activated after registration, allowing the addition of Advertisements and data management.
Advertisement – an invitation to conclude a contract for the sale or purchase of hatching eggs, prepared by the User and published on the Service.
Exchange / Marketplace – a service enabling Users to publish Advertisements and establish commercial contact between the Buyer and the Seller through WolneKurczaki.
Consulting Services – paid or free advisory services and expertise in poultry farming and related topics, provided directly by the Service Provider.

§ 3. REGISTRATION AND USER ACCOUNT

Registration is not required to browse the general content of the Service. Adding Advertisements and contacting advertisers requires creating an Account.
To create an Account, the User fills out the registration form, providing at least:
First and last name / Company name,
E-mail address and telephone number,
Address details and Tax Identification Number (NIP) (in the case of business entities).
The User declares that the provided data is true and up to date.
The User must not share login credentials with third parties.

§ 4. RULES FOR PUBLISHING ADVERTISEMENTS (HATCHING EGGS EXCHANGE)

The subject of Advertisements in the Service may only be hatching eggs (sale or buy requests) and goods strictly related to the poultry breeding industry.
The Advertiser declares that:
a) they have the right to dispose of the offered goods,
b) the offered hatching eggs meet the veterinary and formal requirements arising from legal regulations concerning the trade in biological/breeding material.
The content of the Advertisement must be consistent with the actual state, clear, precise, and not misleading regarding the species, breed, rates, or quantity of the goods.
The Service Provider is merely a provider of the advertising platform (Exchange) and is not a party to transactions concluded between Users. The Service Provider is not responsible for the quality, sanitary/veterinary condition, or proper execution of the contract by the Seller or Buyer.
It is prohibited to post content that is unlawful, spammy, vulgar, or infringes on the rights of third parties.

§ 5. CONSULTING AND EXPERT SERVICES

The Service Provider provides specialized Consulting Services via the Website in the field of breeding, poultry welfare, and related technical and organizational issues.
The scope, date, and price of a given consultation are specified on the subpage of the respective service or agreed individually with the User.
Ordering the service takes place via the application form on the Website or by e-mail.
Consultations are advisory in nature and are based on the best knowledge of the Service Provider’s experts; however, they do not replace official decisions and recommendations of the State Veterinary Inspection.

§ 6. PAYMENTS AND SETTLEMENTS

Registration on the Service and browsing advertisements are free of charge.
Publishing Advertisements and providing Consulting Services may be subject to fees in accordance with the current Price List published on the Website or an individual quote. As of the publication date of these terms, adding advertisements is free of charge.
All payments are made by bank transfer based on a VAT invoice / proforma VAT invoice.

§ 7. COMPLAINTS AND LIABILITY

The User has the right to submit a complaint regarding the operation of the Service or the Consulting Services provided by the Service Provider.
Complaints should be submitted electronically to the following address: biuro@wolnekurczaki.pl.
The complaint should contain a description of the problem and the User’s identification data. The Service Provider considers the complaint within 14 days from the date of its receipt.
Any disputes arising between Users of the Exchange (Buyer and Seller of hatching eggs) shall be resolved by the parties on their own.

§ 8. PERSONAL DATA PROTECTION

The rules for processing personal data and using cookies are specified in the Privacy Policy, available below.

§ 9. FINAL PROVISIONS

The Service Provider reserves the right to amend the Terms and Conditions for important reasons (e.g., changes in legal regulations, changes in the functionality of the Service). Users will be notified of any changes at least 14 days in advance.
In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Act on the Provision of Electronic Services, and the GDPR shall apply.
The law applicable to agreements concluded within the Service is Polish law.

3. Recipients of Personal Data

Personal data may be transferred to external entities cooperating with the Administrator only to the extent necessary for the operation of the Service:

Other Users of the Service – to the extent that contact and company details are published in the content of advertisements to establish commercial contact (purchase/sale of hatching eggs).
IT and hosting service providers – maintaining the servers and infrastructure of the Service.
Accounting and legal service providers – for the purpose of settling provided services and consultations.
Online payment providers (if applicable) – to process payments for services and consultations.
State authorities – solely on the basis of applicable legal provisions (e.g., Tax Office, Police).

4. User Rights (According to GDPR)

Every User has the right to:

Access their data and receive a copy thereof,
Rectify (correct) incorrect or incomplete data,
Erase data (“right to be forgotten”) – if there are no legal impediments (e.g., obligation to store invoices),
Restrict the processing of personal data,
Data portability to another controller,
Object to data processing based on the Administrator’s legitimate interest,
Lodge a complaint with a supervisory authority – President of the Personal Data Protection Office (UODO), ul. Stawki 2, 00-193 Warsaw, Poland.

5. Voluntariness of Providing Data

Providing personal data and/or company details and NIP is voluntary, but necessary to set up an account on the Website, publish buy/sell advertisements, and use the offered consultations and expert services.

6. Cookies and Tracking Technologies

The website wolnekurczaki.pl uses cookies for the following purposes:
Maintaining the session of a logged-in User,
Ensuring the proper functioning of the exchange and forms,
Statistical analysis of website traffic (e.g., Google Analytics).
The User may at any time change the settings regarding cookies in their web browser or block their handling.

7. Data Security

The Administrator applies appropriate technical and organizational measures (including SSL connection encryption) to ensure the protection of processed personal data against accidental or unlawful destruction, loss, modification, unauthorized disclosure, or access.
